We are the data controllers as we are collecting and using your Personal Data.  We use trusted third parties as our data processors for technical and organisational purposes, including for payments and email marketing. We make all reasonable efforts ensure our data processors are GDPR compliant.

International Data Transfers

In order for us to provide the products and services to you, your Personal Data will be stored and processed in Australia. By providing us with your personal information, you consent to us disclosing your Personal Data to third parties located overseas and acknowledge Australian Privacy Principle APP 8.1 does not apply to any such disclosure. When we share data (to the extent that we do from time to time), it may be transferred to, and processed in countries other than the country you live.

BOOKINGS  

The Company uses a Travel Industry Designator Service (TIDS) identification code, assigned by The International Air Transport Association (IATA) for all bookings made with travel and tourism industry suppliers in the IATA network and database.

By making a booking through our website, you are consenting to provide us, with your Personal Data for the purpose of processing and fulfilling your booking as requested by you, in accordance with the Booking Agreement, and with any relevant third parties who form part of the agreement.

You warrant you are giving this information to us voluntarily, and by providing us with this information you are giving us consent to use, collect, process this Personal Data for the purpose of completing the booking service and pursuant to our legal obligations.

You acknowledge that if we cannot collect this and other Personal Data, we will not be able to process your booking and may not be able to provide you with all or some of our Services.

Collection of Personal Information

We collect your personal information when you or a third party acting on your behalf:

(a)       submit a booking inquiry;

(b)      provide your details to us in connection with your flight, holiday or experience booking;

(c)       make or update your flight, holiday or experience booking;

(d)       request Special Assistance, medical clearance, or other arrangements in relation to your booking or on-board experience; and

(e)       provide information in connection with a medical clearance request, safety investigation, complaint or claim.

Collection of health and other sensitive information

We may collect information about you, considered sensitive, (under applicable privacy and data protection laws) which may include:

  • information regarding your health which is relevant to your travel, for example if you make a special assistance request or a meal request indicative of a medical condition or food intolerance, or provide details on a condition where we are required to determine your fitness to fly, or where you were involved in a safety investigation, accident, complaint or claim; and
  • information on your religious beliefs where you make a meal request indicative of a particular religion (e.g. halal or kosher).

We may also handle your health or other sensitive information to comply with our legal obligations, to protect your interests (where you are not capable of giving your consent), where it is in the public interest and in relation to legal claims.

Authority for collection of personal information

You acknowledge we are required under the Customs Act 1901(Cth), Migration Act 1958(Cth), Civil Aviation Act 1988(Cth), Civil Aviation Regulations 1988(Cth) and any relevant International Laws and Regulations, to collect your contact details, passport details and other Personal Data, when organising your travel itinerary.

Who will we disclose your personal information to?

We may disclose your personal information:

  • to our related entities and affiliates;
  • to external service providers and third parties who provide us with (or help us provide) products and services;
  • another person if they made the booking on your behalf, are named in your booking or if they are travelling with you as a support person;

(d)       to security and law enforcement agencies;

(e)       to the account holder or card holder of a credit card, travel bank or other form of payment used to pay for your booking;

(f)        to any other person or organisation from whom you have asked us to obtain or to disclose health and other personal information, for example, your doctor;

(g)       in the event of an emergency or other incident in which you are involved, we may disclose your personal information to government departments and agencies and other support organisations involved in the emergency/incident response, and to your family member(s) who contact us seeking information about you or the emergency/incident.

How long we retain your booking information

We will only retain your Personal Data for as long as we have a relationship with you and for a period of time afterwards where we have an ongoing business need to retain it, in accordance with our data retention policies and practices. Following that period, we’ll make sure it’s deleted or is converted to aggregate data. If at any time you wish to opt out or request us to delete your Personal Data you can contact us at info@wayfarersatlas.com. However, you acknowledge we will not be able to process your booking if you do so at any time prior to the completion of the booking.

Overseas disclosure of your personal information

We are based in Australia, so your bookings will be processed in Australia. However, we will to disclose your Personal Data to countries located outside of Australia where we are required. For European Union citizens who are booking through us, you acknowledge and consent your Persona Data to be transferred outside of the EU.
